وأن كانت لا توطأ لعدمهما أو غيبتهما أو اجتنابهما الوطء عجزا أو قصدا أو غيره ورث: ما لم يجاوز أكثر مدة الحمل أربع سنين.

(وإن كانت) التي وضعت الحمل (لا تُوطأُ؛ لعدمهما) أي: السيد والزوج (أو غيبتهما، أو اجتنابهما الوطء عجزًا أو قصدًا، أو غيره، ورث، ما لم يجاوز أكثر مدة الحمل أربع سنين) إناطة للحكم بسببه الظاهر. وتقدم نظيره في الوصية.
