(وإذا أقرَّ به) أي: الوارث (بعضُ الورثة، ولم يثبت نَسَبُه) المطلق؛ لعدم تصديق باقيهم، وعدم شهادة عدلين (لَزِم المُقِر أن يدفع إليه) أي: إِلى المُقَر به (فَضْلَ ما في يده عن ميراثه) على مقتضى إقراره؛ لأنه مُقِر بأن ذلك له
