(فإن أقرَّ به) أي: بالأخ لأبوين (الأخ من الأب وحده) أي: دون الأخ لأم (أخذ) الأخ لأبوين (ما في يده) أي: يد الأخ لأب؛ مؤاخذة للمُقِر بمقتضى إقراره (ولم يثبت نسبه) المطلق؛ لإنكار بعض الورثة، وهو الأخ لأم.
