(وإن قال) مكلَّف لمكلَّف آخر: (ماتت زوجتي، وأنت أخوها. فقال) مجيبًا له: (لستَ بزوجها. قُبِل إنكاره) أنها زوجته؛ لأن الزوجية من شرطها الإشهاد، فلا تكاد تخفى، ويمكن إقامة البينة عليها. فصل
