(ولو أراد العبدُ إحلافَه (٢) ) أي: إحلاف سيده أنه نوى بحريته ما ذكر (فله ذلك) فيحلف السيد، لاحتمال صدق العبد، فعلى هذا: إن نَكَل قُضي عليه بالعتق.
