(لا) عتق (إذا مثَّل بعبد غيره) لأنه لا يملك عتقه بالقول، فأولى ألَّا يعتق بتمثيله به، وعليه دية ما جنى عليه، على ما يأتي تفصيله فى الجنايات، وملك سيده باق عليه.
