(فإن لم يؤدِّ) الشريك المعتق (القيمة حتى أفلس) أي: حَجَر عليه الحاكم لفلس (كانت) القيمة (في ذمته) فيضرب لربها بها أسوة الغرماء، ولم يبطل العتق؛ لأنه إذا وقع لا يرتفع
