(وإن قال: إن أقررتُ بكَ لزيد فأنتَ حُرٌّ قبله، فأقرَّ له به، صَحَّ إقراره فقط) دون العتق؛ لأنه إذا أقرَّ به لزيد، ملكه زيد، فلم يوجد الشرط إلا وهو في ملك غيره، ويلغو قوله قبله.
