(وإن لم يختر) سيدهُ (أخذَه) بثمنه (بطل تدبيره) بمعنى أنَّه لو مات السيد وهو فِي ملك الآخذ له، لم يعتق بموته، كما لو انتقل الملك فيه عن سيده، ببيع أو هبة.
