(فإن أنكر) المُكاتَب أنها غصب، أو حرام (ولم يكن للسيد بينة، فقول العبد مع يمينه) أنه ملكه؛ لأنه الأصل (ثم يجب) على السيد (أخذه، ويعتق) المُكاتَب بأخذه؛ لأن الأصل أنه ملكه.
