(وإن لم يكن الحاكم حجر عليه) أي: المُكاتَب الجاني، وبادر وأدى إلى سيده مال الكتابة قبل أرش الجناية (صح دفعه إلى السيد) وعتق، لأنه يقضي حقًّا عليه، أشبه ما لو قضى بعض غرمائه قبل الحَجْر عليه، واستقر ضمان أرش الجناية عليه، وتقدم .
