(وسواء كانت الجناية) من أُم الولد (على بدَنٍ أو مالٍ، أو بإتلاف) مال (أو إفساد نِكاح برضاع، كما يأتي في الرضاع) وسواء كانت خطأ، أو شِبه عمد، أو عمدًا؛ وعفا الوليٌّ عن القصاص إن وجب.
