(ولو طَلَّق) الزوج (قبل أخذ الشفيع) بالشفعة (إن قلنا: تثبت الشفعة فيما أُخذ صداقًا) وهو مرجوح (قُدِّم الشفيع) لسبق حقه؛ لأنه يثبت بالعقد، وحق الزوج إنما يثبت بالطلاق.
