(ولو أبى كلٌّ من الزوجين التسليمَ الواجب) عليه (أُجبر زوج) على تسليم الصداق (ثم) تجبر (زوجة) على تسليم نفسها؛ لأن في إجبارها على تسليم نفسها أولًا خطر إتلاف البُضْع، والامتناع من بذل الصَّداق، ولا يمكن الرجوع في البُضع.
