(وإن خالعته أَمَةٌ بغير إذن سيِّدها على شيء) معيَّن، أو في ذِمَّتها (لم يصحّ) الخُلع؛ لأنه تصرُّفٌ من غير أهله، إذ الرقيق بدون إذن سيّده ليس بأهل للتصرف، فلا يصحّ منه، كالمجنون.
