(وعليه) أي: القاطع (الأقلُّ من دية النفس أو المقطوع) لأنه لو لم يرتدّ، لم يجب عليه أكثر من دية النفس، فمع الرِّدة أولى (يستوفيه الإمام) لأن مال المرتد فيء.
