(وإذا قتل أحدُ أبوي المكاتبِ المكاتَبَ) لم يجب القِصاص؛ لعموم ما سبق. (أو) قتل أحدهما (عبدًا له) أي: للمكاتَب (لم يجب القِصاصُ) لأنه لو وجب، لكان للمكاتَب، ولا يثبت له قِصاص على أبويه، كما لو قتلاه، وأولى.
