(فإن قتله الباقون عالمين بالعفو، و) عالمين بـ (سقوط القصاص، فعليهم القَوَد، حكم بالعفو حاكمٌ أو لا) لأنه قتلٌ عمدٌ عدوانٌ أشبه ما لو قتلوه ابتداء.
