(وللباقين) الذين لم يعفوا (حقهم من الدية على الجاني) سواء عَفَا مطلقًا أو إلى الدية؛ لأن حقَّه من القِصاص سقط بغير رضاه، فثبت له البدل، كما لو ورث القاتل بعضَ دمه، أو مات.
