(فإن تساويا) أي المجتهدان (عنده) أي عند الجاهل بأدلتها، أو الأعمى (خير) فيقلد أيهما شاء؛ لأنه لم يظهر لواحد منهما أفضلية على غيره حتى يترجح عليه
