(وإن كان) ما وجب في الجنين (ممَّا لا تحمله العاقلة) لكونه دون ثلث الدية، ومات قبل أمّه، أو بجناية منفردة (فقول الجاني وحده مع يمينه) لأنه الخصم فيه دون العاقلة.
