(وإن كان) المجنيُّ عليه (ألثغ من غير جناية عليه، فذهب إنسان بكلامه كلِّه) بجنايته عليه (فإن كان) الألثغ (مأيوسًا من زوال لُثُغَته، ففيه) أي: الذاهب (بقسطه) من الدية، أي: بقسط (ما ذهب من الحروف) كما لو أذهب سَمعَ أذن، أو شم مَنخِر
