(وإن كان) الواجب (أكثر من دية، مثل أن أذهب سمع إنسان وبصره بجناية واحدة، ففي ست سنين) فيؤخذ (في كلِّ سنة ثُلث) دية؛ لأن الواجب لو كان دون الدية لم ينقص في السنة عن الثلث، فكذا لا يزيد عليه إذا زاد على الثلث.
