(وإن كانوا) أي: الورَّاث (أقل) من خمسين رجلًا (فإن انقسمت) الخمسون عليهم (من غير كَسْر، مثل أن يُخَلِّفَ المقتولُ ابنين، أو) خلَّف (أخًا وزوجًا، حَلَف كل واحد منهما خمسة وعشرين يمينًا) لأن ذلك قَدْر إرث كل منهما
