(وإن سرق وقَتَل في المحاربة ولم يأخذ المال؛ قُتل حتمًا) للقتل (ولم يُصلب) لأنه لم يأخذ مالًا (ولم تُقطع يده) للسرقة؛ لأنه حَدٌّ لله تعالى، فيدخل في القتل
