(وإن شهد شاهدان) بالزنى (واعترف هو) أي: المشهود عليه (مرتين لم تكمل البينة) لعدم تمام النصاب، ولا يُحدّ، لأنه لم يُقِرَّ أربعًا، ولم يشهد عليه أربعة (ولم يجب الحد) على البينة، لتصديقه لها.
