(بخلاف حربي ومرتد، فإنه يصح إكراههما عليه) أي: على الإسلام. (ويصح) إسلامه (ظاهرًا) لحديث: "أُمرت أن أُقاتل النّاس" خصّ منه أهل الكتابين والمجوس إذا أعطوا الجِزية، والمستأمن؛ لأدلة خاصة ، وبقي ما عدا ذلك على الأصل.
