(فإن بادر صاحبُ الطعام فباعه، أو رَهَنه) ونحوه (قبل الطلب؛ صَحَّ) تصرفه؛ لأنه مالكٌ تامٌّ الملك، كالشفيع قبل الطلب. (ويستحِقُّ) المضطرُّ (أخذَه من المُرْتَهِن والمُشتري) كالمالك الأول
