(وإن أصابه أحدُهما بعد صاحبه، فوجداه ميتًا، ولم يُعلم هل صار بـ) ـالجرح (الأول ممتنعًا، أو لا؛ حلَّ) لأن الأصل بقاء امتناعه (ويكون) ملكه (بينهما) لأن تخصيص أحدهما به ترجيحٌ بلا مرجح.
