(وكذا الشجر المُفْرَد، والأرض التي ببعضها بئر أو بناء، أو نحوه) أي: ونحو ما ذكر، فتُعتبر كلُّ عينٍ منها على حِدتها (و) حيث (لا يمكن قسمه بالأجزاء والتعديل) لا يقسم بغير رضا الشركاء كلهم
