(فإن قسموه برِضاهم أعيانًا (٢) بالقيمة، جاز) لأن الحقَّ لا يعدوهم. (وحُكْمُها) أي: قِسمة التراضي (كبيعٍ) لأن صاحب الزائد بَذَل المال عوضًا عمَّا حصل له من حقِّ شريكه، وهذا هو البيع
