(فإن أبى) الممتنع البيع (بِيع) أي: باعه الحاكم (عليهما) لأنه حق عليه، كما يبيع الرهن إذا امتنع الراهن (وقَسَمَ االثمنَ) بينهما بحسب الملك؛ لأنه عوضه (نصًّا (١) . قال الشيخ : وهو مذهب أبي حنيفة ، ومالك ، وأحمد) رحمهم الله.
