(وإن قال لعبده: إن أقررتُ بك لزيدٍ، فأنت حُرٌّ قَبْلَ إقراري، فأقرَّ به لزيد، صَحَّ الإقرارُ) لخلوّه عن المعارض (دون العتق) لأن عتق ملك الغير لا يصح.
