كشاف القناعal-Buhuti

(فإن لم يضمن) المالك زكاتها (وتصرّف) فيها (صحّ تصرفه) لما تقدم أنْ تعلّق الزكاة كأرش الجناية لا يمنع التصرف (وكره) قاله في "الرعاية". أي: تصرفه من غير ضمان زكاتها؛ خروجًا من خلاف من منعه.
