(فإن استبق اثنان إلى معدن في موات، فالسابق أولى به ما دام يعمل) لحديث: "منْ سبقَ إلى مباحٍ فهوَ أحقُّ بِهِ". (فإن تركه) أي: العمل (جاز لغيره العمل فيه) ؛ لأنه مباح لم يملكه الأول.
