(إلا أن يشك) السيد (في حياته) أي: الآبق ونحوه (فتسقط) فِطرته، نص عليه في رواية صالح ؛ لأنه لا يعلم بقاؤه، والأصل براءة الذمة، والظاهر موته، وكالنفقة؛ ولأنه لو أعتقه عن كفارته لم يجزئه
