(ثم إن كان) مال المسلم أو المعاهد المأخوذ منهم (أمَّ ولدٍ، لزم السيدَ أخذُها) قبل القسمة مجانًا (وبعد القسمة بالثمن) ولا يدعها يَستحِلُّ فرجَها من لا تحلُّ له.
