(فإن قُسم) ما أُخذ منهم من مال مسلم أو معاهد (بعد العِلم بأنه مال مسلم أو معاهد، لم تصحَّ قسمتُه، وصاحبُه أحقُّ به بغير شيء) لأن قسمتَه كانت باطلةً من أصلها، فهو كما لو لم يقسم.
