(وإن كانت) الأَمَة المأخوذة من الكفار (جاريةً لمسلمٍ أوْلَدَها أهل الحرب، فلسيدها أخذُها) إذا أدركها كما تقدم (دون أولادها ومهرِها) للحوق النسب لمالك ؛ لأنهم يملكونها بالاستيلاء كسائر أموالنا.
