(وإذا أعتق بعضُ الغانمين أسيرًا من الغنيمة، أو كان يعتِقُ عليه) كأبيه وابنه وأخيه (عَتَق عليه إن كان قَدْر حقِّه) لأن ملكه ثبت عليه في شركة الغانمين باستيلائهم عليه، أشبه المملوك بالإرث
