(ولا جِزية على من لا يجوز قتله، إذا أُسِر) لأن قتلهم ممتنع، وتقدم أن الجِزية بدل عن قتلهم. وكتب عمر إلى أمراء الأجناد:"أن اضْرِبوا الجِزية، ولا تضربوها على النساء والصبيان" رواه سعيد .
