(وإن اتَّجر حربي إلينا -ولو صغيرًا أو أنثى- أُخذ من تجارته العُشر، دَفعةً واحدة، سواء عَشروا أموال المسلمين إذا دخلت إليهم أم لا) لأن عمر أخذ من أهل الحرب العُشر . واشتهر ولم يُنكر، وعمل به الخلفاء بعده.
