(و) يصح بيع قِنٍّ (قاتلٍ في مُحارَبة متحتِّمٍ قتلُه بعد القُدْرة) عليه؛ لأنه ينتفع به إلى قتله، ويعتقه فيجر ولاء وَلَده (و) يصح بيع (متحتِّمٍ قتله بكفر) لما تقدم، وهو داخل تحت قوله:"ومرتد" كما تقدم.
