(وإن شَرَط العبدَ كافرًا) فبان مسلمًا، فلا فَسْخ له. (أو) شرط (الأَمَة ثيِّبًا كافرة، أو) شرط (أحدهما) أي: أنها ثيب، أو كافرة (فبانت أعلى) مما شرط (فلا فَسخ له) لأنه زاده خيرًا، كما لو شرط العبد كاتبًا، فبان -أيضًا- عالمًا. (كما لو شَرَطها سَبْطَةً فبانت جَعْدة، أو) شرطها (جاهلة، فبانت عالمة) فلا فَسْخ له، لما ذكر.
