(فلو كان المبيع) بشرط الخيار مدةً معلومةً (لا يبقى إلى مُضيِّها، كطعام رطب، بِيعَ) أي: باعه أحدهما بإذن الآخر، أو الحاكم إن تشاحَّا (وحُفِظ ثمنه) إلى انقضاء المدة، كرهنه على مؤجل.
