قَالَ: (وَإِذَا مَاتَ الْمَوْلَى عَتَقَ مِنْ ثُلُثِ مَالِهِ) لِمَا رُوِّينَا مِنَ الْحَدِيثِ، وَلِأَنَّهُ عَلَّقَ عِتْقَهُ بِالْمَوْتِ فَكَانَ وَصِيَّةً، وَالْوَصِيَّةُ تُعْتَبَرُ مِنَ الثُّلُثِ،
