(فَإِن أَصَابَهَا) أَي وَطئهَا لَا بِنِكَاح بل (بِشُبْهَة) مِنْهُ كَأَن ظَنّهَا أمته أَو زَوجته الْحرَّة (فولده مِنْهَا) حِينَئِذٍ (حر نسيب) بِلَا خلاف اعْتِبَارا بظنه

(وإن أصابها) أي أمة غيره (بشبهة) منسوبة للفاعل كظنه أنها أمته أو زوجته الحرة (فولده منها حر، وعليه قيمته للسيد) . ولا تصير أم ولد في الحال بلا خلاف.
