قال: فإن عفا عنه الولي فعليه دية واحدة. ش: لا خلاف في هذا نعلمه في المذهب، لأنه قاتل قبل استقرار الجرح، فدخل أرش الجراحة في أرش النفس، كما لو حصل ذلك بالسراية.
