" وَلَوْ فَارَقَ " لَا بِسَبَبِهَا قَبْلَ وَطْءٍ وَبَعْدَ قَبْضِ صَدَاقٍ " وَقَدْ زَالَ مِلْكُهَا عَنْهُ كَأَنْ وَهَبَتْهُ " وَأَقْبَضَتْهُ " لَهُ فَلَهُ نِصْفُ بَدَلِهِ " مِنْ مِثْلٍ أَوْ قِيمَةٍ لِأَنَّهُ إذَا تَعَذَّرَ الرُّجُوعُ إلَى الْمُسْتَحِقِّ فَبَدَلُهُ وَلِأَنَّهُ فِي الْمِثَالِ مَلَكَهُ قبل الفراق من غَيْرِ جِهَتِهِ
