" وَلَوْ رَجَعَ هُوَ " أَيْ الْقَاضِي " وَهُمْ " أَيْ الشُّهُودُ " فَالْقَوَدُ " عَلَيْهِمْ بِالشُّرُوطِ الْمَذْكُورَةِ " وَالدِّيَةُ " حال الخطأ والتعمد بِأَنْ آلَ الْأَمْرُ إلَيْهَا " مُنَاصَفَةٌ " عَلَيْهِ نِصْفٌ وعليهم نصف وشمول المناصفة للمتعمد من زيادتي " أَوْ " رَجَعَ " وَلِيٌّ " لِلدَّمِ
